What is Paternity Leave?
Parental leave, or family leave, is an employee benefit available in almost all countries.
A period of absence from work granted to a father after or shortly before the birth of his child.
How Long Is Paternity Leave In South Africa
In terms of the Labour Laws Amendment Act, an employee is entitled to 10 days of parental leave upon the birth of the employee’s child.
Parental leave may also be applicable in circumstances where an employee legally adopts a child or when a child is placed by a court in the care of a prospective adoptive parent.
Is paternity leave paid or unpaid in South Africa?
According to the BCEA amendments, parental leave is unpaid leave, as is the case with maternity leave, however, employers
and/or companies may opt to pay their employees during these leave days which would differ based on company policies.
How do I claim paternity leave in South Africa?
An employee who intends to take parental leave must submit at least one calendar month’s written
notice to their employer of the date on which they intend to commence parental leave and when they plan to return to work, known as “parental leave notice”.
