What governs a Home Owners Association in South Africa?
A non-profit HOA has a memorandum of incorporation (MOI) that is regulated by the Companies Act 71 of 2008.
The MOI can never contradict the Companies Act. An HOA registered as a common law association has a written constitution that governs the behavior and determines the management of the scheme.
Where do I register my homeowners association in South Africa?
Every HOA needs to register with CSOS. As a result, the HOA is required to disclose details about its financial activities (annual financial accounts),
relevant legal papers (such as the MOI or constitution), and its annual return.
