What are the three cases that the CCMA Cannot solve?
In terms of the Act, the CCMA may not adjudicate the following disputes: Disputes over the non-payment of salaries (below a certain threshold).
These disputes must be referred to the Department of Labour. Disputes are covered by Collective Agreements, Bargaining Councils, or private dispute resolution bodies.
Can I open a case at CCMA online?
Enforcement and or condonation applications can also be submitted on this platform. According to the CCMA, the following referral and application forms are available on the platform: The Labour Relations Act, form 7.11 – This form is used to refer disputes to the CCMA for conciliation and arbitration hearings.
When should I contact CCMA?
For an unfair labour practice, your referral must be made within 90 days of the date of the act or omission, and for discrimination cases, you have six months from the date of the act or omission to refer your dispute (only the CCMA has jurisdiction to conciliate unfair discrimination disputes).
