How do I approach the children’s court in South Africa?

Go to the Magistrates’ court nearest where the child/ren (not the applicant) lives. This is the court that has jurisdiction.

There are two documents that must be submitted to the clerk. An affidavit stating briefly the basis of the claim and why approaching the court is necessary.

What types of cases are heard in children’s court?

A Children’s Court is a special court that deals with issues affecting children. The children’s court also takes care of children who are in need of care and protection and makes decisions about children who are abandoned, neglected, or abused.

How does a court decide who a child lives with?

The Court will make a decision based on what it thinks is best for your child rather than what is best for you or your ex-partner.

In reaching that decision the Court will consider the statutory welfare checklist: The ascertainable wishes and feelings of your child, in light of his or her age and understanding.
